BROKEN FRIENDSHIP
Sale of a Wireless Set.
A broken friendship over the repair and disposal of a wireless set had a sequel at Margate Magistrates Court on Wednesday, when Alfred Moss, of Englefield-road, London, N., was summoned for between February 1st and July 10th, then being the bailee of the set, the property of Mrs. Violet Edith Epps. of Milton avenue, Margate, did fraudulently convert it to his own use and thereby steal it, to which he pleaded not guilty.
Mr. Eric Weale, prosecuting, explained that in February defendant came to Margate and became friendly with Mr. and Mrs. Epps. The latter said her wireless set was not working very well and defendant offered to take it to London and repair it. Later he wrote that he had repaired it at a cost of 35s. The letter was not answered by Mrs. Epps because she was not then in position to pay the amount, but was waiting for an insurance policy to be paid. She saw Mrs. Moss and explained things to her. When the money came through she made arrangements for someone to call at defendant's house to collect the set, but defendant telephoned to cancel the arrangement. Later he wrote calling attention to the time since he heard from Mrs. Epps and stating he had sold the set for £4 10s.
Eventually the matter was reported to the police. Defendant wrote again complaining Mrs. Epps had not answered his letter. It did not appear that the set was wanted and he had lent it to a friend and it had cost another 25s. to repair it. He took the matter in his own hands and sold the set for RA and would send her 3 and keep the remainder to cover the cost of repairing the set.
Evidence was given by Mrs. Epps (who valued the set at 14 guineas), William Joseph Simkins, a driver, of Enfield, and D.S. Butter, Metropolitan Police, the latter of whom stated that when he saw defendant on July 10th he admitted he had sold the set to a man in a street market in London for £4 10s. He repaired the set after taking it back to London, and as it was not collected and his letters were unanswered, he sold it to cover the cost of the repairs.
Defendant did not deny selling the set, but asserted that it was a breach of friendship that Mrs. Epps did not answer his letters. When his wife visited Margate to see her mother Mrs. Epps told her that her husband had won £5 in a football pool and she did not see why she should pay for the repairs whilst he had money. He proposed to send £3 to Mrs. Epps. The model was 11 years old.
Chief Inspector Fleet said nothing was known to the detriment of defendant, who was fined £5, with £3 19s. 3d, witnesses' costs, and allowed 14 days to pay.
