FREDERICK BOWLER, Sprigg's Alley, labourer, V. JOSEPH KEEN, Watlington, innkeeper. - Claim £4:6:10. The particulars included 2s 6d balance for fowls, and £1 8s for labour.- Mr. Wood appeared for defendant, and in stating the case admitted £2 16s 4d of the amount. The two items above were thus in dispute.-Plaintiff, who has for some time past suffered from paralysis of the brain, and was assisted in his evidence by his wife, stated that in 1886 they had a deal with defendant, in which it was agreed he should give 16s. for the fowls. No money passed, and they took to the value of 13s. 6d. out in bacon "when they could get it.” As to the £1: 8s, that was according to an agreement made between the parties, in which plaintiff was to hoe certain wheat for £1, and peas for 8s. The wheat, plaintiff urged, was begun, but defendant stopped him before he finished it, setting him to hoe some potatoes instead, which he said were to be done in place of the wheat.-Defendant, as a set-off, claimed for moving plaintiff's furniture in his van, and also for seven poles of land he ploughed up and lent plaintiff. -Plaintiff said he thought defendant moved the furniture and lent him the land "as a kindness." His Honour: You seem to have done your business in a strange manner. - Defendant denied owing the 2s. 6d. for the fowls, and said he paid for the work plaintiff had done for him.- His Honour, addressing plaintiff : You say defendant did you a kindness by moving your furniture; will you not do him a kindness by striking off the 2. 6. for the chickens? - Plaintiff's wife (after some hesitation): Yes, I will for the fowls, but not for my husband's work. - Defendant said plaintiff hoed part of the wheat, after which he left it until the ground became so hard he could not finish it, and it was the same about the peas. His Honour, having carefully considered the evidence, His Honour, having carefully considered the evidence, said he was bound to believe defendant's story as a very reasonable one. Doubtless plaintiff, afflicted as he was, most likely forgot whether he had finished the work or not. There must be an end to the dispute. Mr. Wood had admitted £2 16s 4d; as to the amount in dispute a verdict would be entered for defendant, each party to pay their own costs.- His Honour (to Mr. Wood): Has defendant paid the £2 16s 4d into Court? - Mr. Wood : No, your Honour, unfortunately he has not got it. - An order for 5s. per month was then made.- As the parties were leaving the Court a slight disturbance was heard in the ante-room, and Mr. Wood, re-entering the Court, intimated to the Judge that plaintiff's son-in-law had used abusive language to him and to the defendant. - His Honour ordered the man to be brought into Court, placed in the box, and both Mr. Wood and defendant sworn. -Defendant, in reply to his Honour, stated that he did not hear what the man had said. Mr. Wood said he used very bad language, and threatened to do for them. The man said he only told defendant he ought to pay the money. He would take his solemn oath he did not use the expression Mr. Wood repeated; what Mr. Wood had said was untrue. - His Honour: I do not believe you. I thoroughly believe Mr. Wood. As to taking your oath, I shall not give you an opportunity of committing perjury in my Court. Do you know the peril you stand in now? You are liable to be sent to prison for six days. You will apologise to the Court, to Mr. Wood, and to defendant. - Plaintiff's son-in-law : I will, Sir. - His Honour: And consider yourself extremely lucky you are not sent in custody from this Court to Oxford gaol, Get away. I will have to witness, or advocate, or anyone connected with any case threatened in this Court. If I find anyone threatening in the Court I will have them sent to prison. I am very much obliged to you, Mr. Wood, for bringing this before me. - Mr. Wood: Thank you, your Honour; it is not the first time men have come in this way to witnesses or solicitors. -Later on, Mr. Wood informed his Honour that the plaintiff had threatened defendant, but as this occurred outside the precincts of the Court, his Honour advised defendant to take the man before the Magistrates, as it was a case for them; had it taken place within the Court he would have sent plaintiff to gaol for six days.
