The Result of a Bicycle Accident
Abel Bass, of Chinnor, Oxon, was charged with being drunk and incapable on the highway at Princes Risborough on June 18th.
Defendant was legally represented by Mr. E. Woodward, from the office of Mr. R. S. Wood, of High Wycombe.
Police-sergeant Harrowell stated that he was called to defendant at 11.30 p.m. on that date by two tramps, and found him lying by the roadside with his bicycle on the Culverton Pitches. He appeared to be the worse for drink, and had evidently fallen off his machine, as his face was cut and his hands grazed. He was in a dazed condition, and stated that he had ridden from Little Marlow, where he had been to see his brother. He assisted him to walk to the Black Prince public house, where, after being washed by the landlady, he was put to bed, and he remained until the next morning at 11 o'clock, when he started for home.
Mrs. Marsh, landlady of the public house mentioned, gave evidence that in her opinion defendant was the worse for drink, as he could not sit up, and smelt strongly of liquor.
Cross-examined-Witness said she was not pre- pared to state that his unsteadiness could not have been the result of an accident.
Abel Bass, the defendant, was next put in the box, and on oath stated that he had been to Little Marlow on that day to visit his brother, and left at 6 p.m. to ride home. He arrived at High Wycombe at 8.45 p.m., and had no intoxicating drink that day till then, when he shared two pints of beer at the Half Moon. He did not stop anywhere else, but coming down the Culverton Pitches near Risborough he put his front brake on hard, which caused the machine to throw him over the handle-bars. He did not recollect anything more until the Sergeant roused him up, and took him to the public house, where he stayed the night. He had been suffering from the effects of the accident ever since, and was attended by Dr. Boyton from Watlington.
William Bass, of Pigeonhole Farm, Little Marlow, corroborated defendant's statement that he had no drink while he was with him, and that he was perfectly sober when he left for home at 6 p.m.
John Bass, of Chinnor, father of defendant, stated that his son reached home on June 19th about midday. He was in a dazed condition and apparently ill. They sent for the doctor, who came next morning, and he certified him to be suffering from the effects of concussion. He had been under medical treatment ever since.
Dr. E. T. A. Boyton, L.R.C.S.E., said that he was acting as locum tenens for his brother, Dr. Boyton, of Watlington, who first attended defend- ant, and certified him to be suffering from concussion. He had attended him on his brother's behalf since July 4th, and had no doubt that his condition when found by Sergeant Harrowell was due to the accident. The symptoms were easily mistaken, and it was probably the smell of beer that led Sergeant Harrowell to suppose the man was under the influence of drink. He was of opinion that the state defendant was found in was caused by the accident.
This concluded the evidence, and the case was promptly dismissed
